Welcome to the Sun Cabo Store. It is important that you review this agreement because by accessing this website and by placing an order with us online, you agree to the terms of this Agreement (the “Agreement”) which shall cover the terms of our deliveries to you and your use of our website. This Agreement is between you and Sun Cabo Store (hereinafter referred to as “We”, “Company”, and/or “Sun Cabo Store”) that states the terms and conditions under which you may use the site and receive deliveries from us.

OUR DELIVERY SERVICE

When you place an order 72 business hours prior to your arrival, we will use all reasonable efforts to deliver your items before your arrival at the property. For orders placed less than 72 hours will incur a $25.00 surcharge. Orders placed within 24 hours will incur a $50.00 surcharge. Orders for Same-Day delivery will incur a $75.00 surcharge. We reserve the right to change the cost of deliveries and/or our delivery fees at any time. In the case of bad weather or unforeseen delivery complications, deliveries may be delayed. We will make every effort to get your groceries to you before arriving at the property rental. By placing an order online with Sun Cabo Store you understand orders can only be delivered to Sun Cabo Vacations guests traveling to Los Cabos Mexico. As a guest staying with Sun Cabo Vacations I confirm my Arrival Date and Villa information provided are correct. If incorrect information is given, I understand my order will not be delivered in a timely manner and is non-refundable.

PRICE AND AVAILABILITY

From time to time, products you order may be unavailable. If we are unable to fulfill your entire order, we will make every reasonable effort to substitute with a similarly priced product, if you’ve chosen this option at checkout. If you’ve chosen not to have your item substituted we will refund you.

Product information contained on the website is offered as a convenience and should not be deemed as accurate. Information contained on the website should not be used by you to evaluate ingredient information, nutritional values, or potential food allergies. The Company assumes no responsibility for such information.

CHARCUTERIE ITEMS

Charcuterie boxes require a minimum of 24 hours notice and the delivery fee is included in the price. If order(s) are placed less than 24 hours and cannot be fulfilled, the order will be refunded. Charcuterie In-Villa setups require a minimum of 48 hours notice and the delivery, pickup and setup fee is included in the price. Display board(s) and/or dish(es) used will be collected the next day, please set aside for easy pickup. Display board(s) and/or dish(es) do not need to be washed but food must be removed. Un-removed food will result in an additional $50 cleaning charge. Customers are responsible for the cost of any missing items at the time of pick up. 48 hour cancellation notice is required for all setups. Setups canceled less than 48 hours will incur a 50% cancellation fee. Less than 24 hours there is no refund.

CANCELLATION POLICY 

  • 72 hours or more prior to delivery: Guests are eligible for a full refund of any charges related to their order.
  • Between 48 and 72 hours prior to delivery: A cancellation fee of 25% of the order total will apply.
  • Less than 48 hours prior to delivery: The order is non-refundable.

PAYMENT

We only accept credit cards. If you fail to pay any fees or charges when due, we may charge such an amount directly to the credit card on file or on your check-in document. You shall be responsible and liable for any fees, including but not limited to attorney’s fees and collection costs, that we may incur in our efforts to collect any unpaid balances from you.

COPYRIGHT AND OWNERSHIP

Unless otherwise noted, all materials, including images, text, illustrations, designs, music clips, downloads, icons, photographs, programs, video clips and written and other materials that are part of this site are property of, or duly licensed to Sun Cabo Store. You are not authorized to save or collect any such information. Any other use of materials on this site, including modification, distribution, or reproduction is strictly prohibited. You acknowledge that Sun Cabo Store and/or third-party content providers remain the owners of such material and that you do not acquire any of those ownership rights by downloading copyrighted material.

ENTIRE AGREEMENT

This Agreement and the Privacy Policy referred to herein represent your entire agreement with Sun Cabo Store regarding the use of the service and the Site. You agree that this Agreement is not intended to confer and does not confer any rights or remedies upon any person other than you and Sun Cabo Store. If any portion of this Agreement is held invalid or unenforceable, that portion shall be construed in accordance with applicable law as nearly as possible to reflect the original intention of the parties, and the remainder of this Agreement shall remain in full force and effect. The failure of either party to insist upon strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right.

FUTURE AMENDMENTS

Sun Cabo Store may amend this Agreement at any time by posting the amended terms on our site. All amended terms shall automatically be effective at the time they are initially posted on our site. By accessing this site after the effective date of any such amendment, you agree to be bound by any such revisions and should therefore periodically visit this page to determine the then current Agreement to which you are bound.
